Personal data protection code and request for consent in accordance with articles 13,23 and 26 of Italian Legislative Decree no. 196 of 30/06/2003, relative to the safeguarding of the processing of personal data.

We hereby inform you that Italian Legislative Decree no.196 of 30 June 2003 (“Personal Data Protection Code ) foresees the safeguarding of persons and other subjects in respect of the processing of personal data. In accordance with the above mentioned personal data protection code, the processing of your personal data will be based on the principles of correctness, lawfulness and transparency and on the safeguarding of your privacy and your rights. In accordance with article 13 of Italian Legislative Decree no. 196 of 30 June 2003, we hereby provide you with the following information:

1. Purpose and method of data processing:

Your personal data will be processed exclusively for purposes strictly connected to the fulfillment of the contractual relationship and, in particular: for the entry of personal data files of corporate IT data bases to comply with the obligations foreseen by the rules of civil and fiscal law and community regulations. The processing of personal data will be conducted by means of paper and IT supports by the controller who guarantees their safety and confidentiality.

2. Nature of data collection and consequences of failure to give consent to perform said collection:

Giving consent to process your personal details is compulsory in order to comply with the obligations deriving from the contract and, in general, from the provisions of law. Failure to give your consent to the processing of your personal data could prevent us from fulfilling contractual obligations.

3. Communication and dissemination of personal details:

For contract fulfillment purposes and for the above mentioned purposes, your personal details may be communicated: to all individuals and corporate bodies (legal, administrative and fiscal consultancy offices requiring communication of same for the above mentioned purposes) to the media, buyers and companies in the sector to banking institutes for the handling of earnings and payments and to factoring or debt recovery companies said data may be disseminated through the www.altaroma.it. website

4. Data Subject’s Rights:

At any time whatsoever, the data subject reserves the right to exercise his or her rights in relation to the holder responsible for the handling of personal data in accordance with article 7 of Italian Legislative Decree no. 196 of 30 June 2003, as listed below:

  1. The data subject has the right to obtain confirmation of the existence or otherwise of personal data concerning him or her, even if not yet registered, and their communication in an intelligible form.

  2. A data subject shall have the right to be informed:
    A) of the source of the personal data;
    B) of the purposes and methods of the processing;
    C) of the logic applied to the processing, if the latter is carried out with the aid of electronic means;
    D) of the identification data concerning the data controller, data processors and the representative designated as per article 5, paragraph 2;
    E) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may learn about said data in their capacity as designated representative in the State’s territory, data processors or persons in charge of the processing.
  3. A data subject shall have the right to obtain:
    A) updating, rectification or, where interested therein, integration of said data;
    B) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
    C) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
  4. A data subject shall have the right to object, in whole or in part:
    A) on legitimate grounds, to the processing of personal data concerning him or her, even though they are relevant to the purpose of collection;
    B) to the processing of personal data concerning him or her, carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.

Formula of acquisition of consent by data subject

Having acquired the information provided by the controller of the processing of personal data in accordance with article 13 of Italian Legislative Decree no. 196/2003, in reference to the present request for consent aimed at:

  • The processing of sensitive personal data for the purposes outlined in the above mentioned personal data protection code
  • The communication of personal data for the aims and to the subjects indicated in the personal data protection code
  • The dissemination of personal data for the purposes and within the ambit indicated in the personal data protection code
